Lagos Lawyer Drags INEC To Court Over Kogi Election Decision

Ebun-Olu Adegboruwa, a Lagos-based lawyer and human rights activist has dragged the Independent National Electoral Commission (INEC) to court over its decision to grant the All Progressives Congress (APC) the right to provide a candidate to replace the late Abubakar Audu.

The Kogi election had been declared inconclusive by INEC on Sunday, November 22 and a supplementary election scheduled for Saturday, November 5. The sudden demise of Audu, the APC gubernatorial candidate created a void which necessitated the electoral commission to take action. The APC was allowed the opportunity to present a candidate and there is a strong indication that Audu’s son, Mohammed Audu might be selected to fill the void.

Leadership reports that Adegboruwa dragged the attorney general of the federation, Mallam Abubakar Malami and the electoral commission before the federal high court in Lagos on Thursday, November 26. He begged the court to direct INEC to cancel the Kogi election.

Adegboruwa is also begging the court to direct INEC to conduct fresh elections and not allow APC provide a substitute candidate for the supplementary election.

Agbegboruwa is asking the court to determine whether by virtue of Section 179(2) of the 1999 constitution, the late Audu had been duly elected to warrant the proposal by the APC to substitute him with another candidate for the purpose of a supplementary election.

The lawyer also wants the court to decide, whether the APC had an exclusive right to the joint ticket on which the late Audu contested to entitle the party to nominate another candidate to conclude the said election.

James Faleke, the running mate of Audu wrote a letter to INEC arguring that he should be declared the APC’s candidate and revoke its decision that the party provide a fresh candidate.
