Rivers Governor : Fubara presents 2024 budget to five Rivers lawmakers

Governor Fubara has presented the 2024 Rivers State appropriation bill.

The governor arrived at the plenary of the assembly under the speakership of Rt. Hon. Edison Ehie, around 9:00 a.m.

Fubara was accompanied by the Secretary to the State Government, Tammy Danagogo, Commissioner for Finance, Isaac Kamalu, the Commissioner for Information and Communications, Joseph Johnson, and other members of his cabinet.

The State Executive Council, in its 5th sitting on Monday, approved the estimated budget of over N800 billion, christened the Budget of Renewed Hope, Consolidation, and Continuity for the 2024 fiscal year.

During the Wednesday proceedings, Edison also declared vacant the seat of 27 of 32 lawmakers that defected to APC.

This is coming after the demolition of the State House of Assembly building on Moscow Road, Port Harcourt City Local Government Area.

According to a government source, the project was being undertaken by the state government.

Recall that the hallowed chambers of the state assembly were burned down by unknown political thugs.

The legislative arm of the state has been involved in a serious crisis following the move by some lawmakers to impeach Fubara.

However, as early as 5 a.m. on Wednesday, over 10 bulldozers, excavators, and other heavy-duty machines were brought to the assembly complex.

The demolition commenced at about 7:30 a.m. As of the time of this report, the process is still ongoing.

Asari Dokubo, on Friday, asked President Bola Tinubu not to release the leader of the outlawed Indigenous People of Biafra (IPOB), Nnamdi Kanu.

Asari Dokubo, on Friday, asked President Bola Tinubu not to release the leader of the outlawed Indigenous People of Biafra (IPOB), Nnamdi Kanu.

But addressing journalists after meeting with President Tinubu, the Niger Delta leader said Kanu should face the law.

Releasing Nnamdi Kanu is rewarding criminality and rewarding gruesome murder of innocent people,” he said at the Presidential Villa in Abuja. “He should face the law for the actions and instigations he has carried out.

“On security, I want to clearly say that there are full-scale wars going on in different parts of this country. In the South East, the IPOB/ESN is waging a full-scale war against the government of this country and many local governments, many communities are deserted, schools are closed, and hospitals are closed.”

Away from the IPOB leader, Dokubo also spoke about crude oil theft in the country, accusing the military of masterminding it.

He also claimed that some powerful cabals operating from Abuja are involved in the crime.

Asari Dokubo on Friday after visiting President Bola Tinubu promised to do all in his power to stop oil theft in the Niger Delta region.

Asari Dokubo was calm and was monitoring every oil theft during Buhari's administration by his friends and families, now it's Asari's turn but one will ask if it's really his duty to stop oil theft or an instrument.. Your guess is as good as mine

TODAY'S PROCEEDINGS... PETER OBI VRS INEC & OTHERS -

*COMPREHENSIVE UPDATE OF TODAY'S PROCEEDINGS AT PEPT ,ABUJA IN CASE BETWEEN PETER OBI VRS INEC & OTHERS - 16/06/2023*

The secretary just walked in and made an announcement.

Someone stole a laptop belonging to a lawyer yesterday.

The laptop was stolen during PDP’s case.

The CCTV picked up the face of the person who stole the laptop and they are actively searching for him.

Everyone has been advised to hold their properties close and watchful since people are now stealing in the courtroom.

The judges are now seated.

Justice Tsammani: Good Morning everyone, let’s get full cooperation today. Remember today is Friday so let’s be timely.

The clerk has now announced the case.

Peter Obi is now with the microphone with a face full of smile.

Peter Obi: Respectfully my lord, I am Mr. Peter Gregory Obi for the petitioners.

The APC representative is also here.

Saturday Monsignia: May it please this honourable court, I am Saturday Monsignia Esquire, Deputy Director Legal Services APC.

This one Saturday has started adding Esquire to his name, he doesn’t use to say it before oh, he wants to oppress us that are Esquire by association.

Lead Counsel:

Labour Party - SAN LIVY UZOUKWU

INEC - SAN AB MAHMOUD

Tinubu and Shetimma - SAN AKIN OLUJIMI

APC: SAN LO FAGBEMI

SAN Livy is now with the mic without wasting time.

SAN Livy: My lord, we would like to continue with the witness from yesterday.

The witness steps out, and he’s reminded that he’s still on oath

INEC: Good morning

Witness: Morning

INEC: Can you tell the court where you were on election day

Witness: On election day

INEC: Answer me properly. I know you have been thought to repeat after me to waste my time

LP: Objection that’s wrong

Justice Tsamamni: Why would you say that where you there when he was told

INEC: Where were you, Mr. Mathematical Statistician

Witness: I voted

INEC: Where you requested to do the Labour Party analysis

Witness: I was requested to produce the report

INEC: And you were paid for it

Witness: Nobody paid me for it

INEC: You acted like a patriotic Nigerian

LP: Objection it’s too early to be standing up. That’s not right

Justice Tsamamni: Ikwueto let him go on, please

INEC: You did it as a patriotic nigerian

Witness: I am a patriotic Nigerian, and I wanted to have something to teach my student with.

INEC: Your primary source of data was IREV portal

Witness: Yes

INEC: In your witness statement, you made reference to forms EC8As as well as results uploaded on the IREVs

Witness: Not really

INEC: What do you mean by reports on the IReV portal

Witness: It is copies of forms EC8As uploaded

INEC: IREV and EC8As you’re referring to the same document

Witness: No, they are different

INEC: What’s the difference

Witness: The forms of EC8As are like this (holding a paper) while the ones on IREVs are copies of it

INEC: The form EC8A uploaded on the portal is the only thing you see on IREV

Witness: Not really

Justice Tsammani: Not really is not an answer

Witness: I said not really because his question doesn’t need a definite answer.

INEC: The form EC8A is the only thing you’d see on IREV

Witness: No

INEC: What else

Witness: There were blurred images

INEC: What else did you see

Witness: Some of them did not relate to the analysis done as, for instance, senate and HOR results were there on presidential

INEC: Prof, when you refer to blurred EC8As on IREV, you don’t expect the physical copies to blur

Witness: I didn’t see the physical copies

INEC: In all your reviews, you didn’t see anything on the portal that suggests there’s an electronic collation on the portal. Am I right

Witness: Anything electronic

INEC: You’re a prof I’m sure you speak English clearly

Witness: The portal is an electronic collation system

Justice Tsamamni: The portal, just the portal

Witness: Yes

INEC: Are you suggesting to the court that the portal can collate and tabulating result

Witness: The portal can only hold what you input, so it’s not capable of doing that

INEC: You made mention of 18,088 blurred EC8As, and you were made to use the LP agents sheets for your analysis

Witness: I didn’t only use Labour Party agents forms

INEC: You referred to Labour Party agents' results

Witness: That part says

INEC cuts in: I didn’t ask you to read it.

You referenced Labour Party agents

Witness: Yes, I did

INEC: So where are their EC8As? Did you attach them to your report

Witness: I believe it has been tendered.

INEC: Did you attach it

Witness: No, I did not

INEC: You’re not an election expert, Prof

Witness: It depends on what you mean by election expert

INEC: What do you understand by that. I suggest that there’s no way you could have undertaken the task on paragraph C3 of your witness statement, which states compliance regulations and electoral rules of INEC

Witness: If I understand you clearly, the elections act, and the guides state there should be online transmission

INEC: Are you an election expert?

Can you declare compliance

Witness: Yes, I can declare compliance

INEC: Can you confirm with the court when you concluded your assignment to LP?

Witness: It was 19th of March

INEC: Look at the Rivers State document, Degema LGA of Rivers

Read the Polling Unit

Witness: Omoge Memorial Hall

Justice Tsammani: Let’s have the PU number

Witness: 002

Justice Ugo: What’s the Ward

INEC: Ward 7

INEC: Ao witness, what’s the accredited voters, it’s 40 correct, number of voters is 40 correct

Witness: Correct

INEC: There’s no over voting, correct

Justice Ugo: Help us, na, his time is going

40 plus 40 is 80

Witness: There’s no over voting.

INEC: That would be all my lord.

Tinubu’s Lawyers

Tinubu lawyer: Your report covers only 2 states, Benue and Rivers State

Witness: At the point when the report was requested for

Tinubu lawyer: But you covered only 2 states

Witness: No, I did all the states, but those were the 2 I could present when I was called to tender, and the documents tendered speak for themselves

Tinubu: Please, Prof., do not be rude. Answer my question

Witness: I didn’t mean to be rude, my lord

Tinubu: You tendered for Benue

Witness: Yes and others

Tinubu: Did you tender for rivers

Witness: Yes

Tinubu: So why didn’t you tender for Oyo State

Justice Tsamamni: So you want him to tender for your own state

Tinubu: So apart from Rivers State, which other state did you tender

Prooooof

Prof, which other state did you tender

Witness: You’re asking the questions and no smiling so I don’t get you

‘The whole courtroom is laughing’

Tinubu lawyer: You have not played with this witness statement to have done any analysis for a court case in election matter like this

Witness: No

Tinubu lawyer: You have never done it, okay.

You said you were requested on 20th Feb 2023 by LP to carry out data analysis of the elections that have not even been held.

Witness: Yes

Tinubu lawyer: So all this was done in anticipation that the Labour Party would lose the election

‘The whole courtroom shouts AHHH’

Witness: No that’s not it.

Tinubu lawyer: You were also in that engagement requested to determine INEC’s compliance of the regulations of the electoral act.

Witness: Yes

Tinubu lawyer: So I find it strange that after 20th Feb 2023, you didn’t give them what they contracted you for.

Now you’re here in subpeona

Witness: Well, at the point of start of the contract, I didn’t expect to be in court. And I took the job as I saw a means of helping my student.

Tinubu lawyer: So

Justice Tsammani cuts in, I believe you heard the bell

Your time is up.

It’s now time for APC

APC: My lord, I am very weak in mathematics

Justice Tsamani: But you’re here to find x

APC: I will pass the mic to my colleague SAN Owonikoko

APC: You’ve done well in your career

What’s a theory in mathematics to say a document is blurred

Witness: There’s no theory

APC: So I will be correct to say that your report, based on that part, is not on expertise. Anyone that isn’t blind would see what is blurred right

Witness: Of course

APC: What level of numeral literacy does one require to do the addition of polling units result

Witness: If we go by what you asked, INEC won’t use experts

APC: So you don’t need an expert to do simple arithmetic

Witness: Depends on what you mean as simple and arithmetic is not so simple, and experts are needed at some point

‘He’s talking so fast’

Witness: You don’t need expert

APC: Your choice of rivers and benue as touch stone of your analysis was a random pick and not based on any theory

Witness: Yes, it was random

APC: You were aware that at the presidential election, 3 leading parties won a number of states in line of votes

APC, ELLU PEE, and PDP

‘Everyone is laughing’

‘Why did APC lawyer pronounce LP like that, abi he’s a backyard Obidient’

Witness: My job has nothing to do with who wins and who did not

APC: But did you know as a Nigerian who won

Witness: What it seems may not be what you’ve heard.

Justice Bolaji: Are we recording, or we don’t need this because we need to record

APC: Who won the election in Rivers based on what INEC announced

Witness: Based on what INEC declared, I don’t know

APC: Okay, you don’t know who won in Benue State

Witness: Who won is different from who was declared.

APC: You used 2 states that were won by APC

Witness: I can not say for now

APC: The exercise you carried out here has some elements of statistics

Witness: Actual I dealt on exact data

APC: We will find that out today.

What you did was sampling

Witness: No, sampling has to do with forecasting. This was done with the exact result

Justice Bolaji: It is as if it’s only 2 of you who understand what you are doing.

APC: You don’t know what rivers PU is or Benue, but the total of Rivers State and Benue doesn’t reach up to 18,088 blurred you have mentioned.

Witness: It’s not connected

Justice Bolaji: he’s saying it’s not adding up

Witness: Yes, it doesn’t because it’s not connected

LP: My lord, understand his answer he said it’s not connected

Justice Bolaji: that’s not the answer to the questions

APC: he has answered, "I got f9 in maths, so no problem, do what you want."

APC: As a researcher, without being a statistician, you have to be conscious of the sampling data used

Witness: Like I said before, the data I used is exact data. There’s no random data

APC: So your choice of Rivers where APC won and Benue was not random sampling and not based on bias

Witness: I think you’re referring to 2 different things

APC: I am not

Witness: My lord, when it comes to the data before us it’s exact data, but when it comes to sampling states, I picked randomly

APC: Is it right to teach your students based on these 2 states where APC won

Witness: Well it’s not in the point to bring in my students

APC: In your report, you analyzed forms EC8A forms as uploaded on IRev as results on blurred, but you didn’t include EC8B, C, or D

Witness: I based it on EC8A because what it’s at PU level would destabilise everything else from the ground up.

APC: Hmmm, okay, that would be all

Re-Examination

SAN Ikwueto: So when you mentioned that if you use other forms EC8 apart from A

Justice Bolaji cuts in: Well, his answer was clear

Ikwueto: As my lord wishes, I am also in the over voting aspect

INEC: Objection: He wants to change the witness answers that’s not right

LP: Well, he needs to clarify

Justice Ugo: Well it’s clear I heard him

LP: Okay, as the court wishes

The witness from Arise TV is now back for cross examination

He is reminded of his oath.

INEC’s lawyer immediately stands up and states that he doesn’t have any questions for him.

INEC lawyer stands up again

INEC: My lord, I’ve changed my mind. I have questions

INEC: What is transfer

Witness: Transfer is the movement of data from one designated location to a non designated location

INEC: And what is transmission. It is different from transfer, right

Witness: Yes

INEC: So when you broadcasts you’re actually transmitting right

Witness: Yes

INEC: So you transmitted this

Witness: Yes

INEC: That would be all

Lol what’s all this

Tinubu’s lawyers are now up

Tinubu: Witness, will you confirm that you were not present at Chatham house during this on 17th jan 2023

Witness: Physically, no, it was live streaming, so I was present online

Tinubu: So you were not in Chatham house, you were not invited.

The INEC Chairman Prof. Yakubu Mahmoud is still alive today

Witness laughs: 😀

Yes, I believe so, as far as I know

Tinubu: That would be all my lord

APC Lawyer Owonikoko is now up

APC: Can you summarize the relevance of the video you played

Witness: INEC decided to use technology for the elections

APC: Part of that development of technology would include the use of BVAS exclusively for voters

Witness: In my understanding

APC: Before 2019, voters' register was used, and there was no use of BVAs

Witness: Yes

APC: It was introduced in 2023 election

Witness: I believe so

APC: Would I be right to say you are familiar with the guidelines of INEC Electoral act for 2023 elections

Witness: I am not totally familiar

APC: From the flash that you played, we heard the Chairman of INEC indicating that copies of forms EC8A would be snapped and uploaded on the IReV portal, am I correct

Witness: Yes

APC: Contents that would be aired live gets to be viewed by editor either live or online

Witness: Most times

APC: After the 17th of January, do you agree that a federal high court

LP cuts in: Objection, my lord, my witness brought a flash drive to play his video by his company. Why is he asking about federal court

What’s his business.

Justice Tsammani: So what did his testimony state

LP: That he’s coming here to give evidence of what was covered on that video

Justice Ugo: Let him ask the question before you raise the objection. My only issue with what Owonikoko is saying is the part of federal court, so let him finish. If it’s wrong, we would address

Justice Bello: You can’t phantom his question. Let him ask it first, and once he’s done, you will object

APC: I just want to ask him about the federal court

Justice Tsammani: Move on from that question. You can’t ask him that, did you tender any federal court document here. You can’t ask him that

APC: Are you aware that after that interview, INEC said they would no longer electronically transmit the election result

‘Everyone in court shouts a loud aahhhhhhh’

Ahhhhhhhh

Owonikoko has started

What is this.

Witness: I am not aware that ever happened.

APC: In a newspaper dated 23rd from Tribune, INEC said they won’t use any electronic transmission. Did you see it?

Justice Tsammani: You can’t ask him that, it’s not his company, he didn’t edit or write that. If you want it in evidence, come and tender it so we can see.

APC: Okay, that would be all my lord.

Labour Party lawyers have now brought in a witness from AIT after much argument from the court.

The judges said there’s no more time

SAN Livy insisted the witness have to be heard today because she would be attending the burial ceremony of the DAAR Communications boss who died recently.

Justice Tsammani: If it won’t take more than 30 minutes, then go ahead.

SAN Ikwueto has now called out the witness.

The witness has now stepped forward, and she’s been sworn in.

Hmmm, Labour Party’s first female witness.

LP: Tell the court your name

Witness: My name is Ijeoma

LP: Tell the court where you work

Witness: I work at DAAR Communication Limited, the owners of AIT Africa Independent Television, and I have my ID card to prove that.

LP: Tender the ID Card

There was no objection from the respondents on the ID card tendered.

LP: So you’re here to show us something, where is it

Witness: It’s on this flash drive.

LP: We seek to tender my lord.

The flash drive has now been tendered to bar.

All respondents have objected to the flash drive being tendered

LP: You have the subpoena sent to your company right

Witness: Yes, I do

LP: We wish to tender my lord.

There was no objection from the respondents to the tendering of the subpoena from AIT

We are now about to watch the film.

Ahn Ahn

The film is not playing, oh

INEC: There’s a problem with the transmission. There are glitches. It happens all the time

Witness: If you see the witness statement, will you identify it?

LP: Yes, by my signature. She now identifies the document.

SAN Ikwueto: now applies to the court for the flash drive to be played.

There's no objections to the video being played by all respondents.

A video is now being played. It shows Ijeoma Osamor on Democracy today, where she also played a video where Mahmoud is heard to say copies of results will be uploaded to IREV by the BVAS device.

He further assures Nigerians that BVAS has come to stay and ' results will be uploaded. Real-Time and Nigerians will view it being uploaded directly from the polling unit.

He also assures that it will be done in real time, that it has been done in other elections, and will be done now.

On collection of PVCs, he assures Nigerians that the commission will soon release the guidelines for the further collection of the PVCs.

"That brings it to an end of the video of about 3 minutes."

CROSS-EXAMINATION

INEC: No question, but thanked the witness for coming.

Tinubu and Shettima : That video you just played, you said in your witness statement that you anchored the program?

Witness: Yes, sir.

Tinubu: You had cameramen of AIT who took pictures of that program

Witness: Yes, every studio, there are cameramen

Tinubu: It's not part of your duty to handle the camera?

Witness: No, it's not.

Tinubu: Now, you said the program was streamed live on Facebook and YouTube?

Witness: Yes, my Lord

Tinubu&Shettima: The only other role that you played before we got to this video was that you went to Facebook to download it with your phone?

Witness: Yes

Tinubu: You transferred the video from Facebook to the flash

Witness: I used my phone to get the video when I was asked to provide a copy of the video by the subpoena

Tinubu: How come about the flash drive

Witness: Flash drive was from the office. I sent what I downloaded to them. I sent the link to the office and further transferred it to the drive.

Tinubu: There were 3 levels of operations before the flash drive.

Witness: Yes

Tinubu: The National Chairman of INEC seen in the video is still alive

Witness: Before I came into the court, he was alive, I don't know thereafter.

APC step up

Apc: The report that took place in your program was an event outside of the AIT?

Witness: Yes, my Lord

Apc: The program Democracy Today is anchored inside the AIT Studio?

Witness: Yes, my Lord

Apc: And the AIT crew attended that program?

Witness: Yes, my Lord

Apc: It was their recording brought back to the studio you played during your program?

Witness: Yes, my Lord

Apc: Please, what's the duration of Democracy Today?

Witness: It's 55 minutes

Apc: Every short program, a copy of the recording must be kept in the studio

Witness: Because we stream live. We have the studio copy and online copy

Apc: The one you brought to the court, you got it from cyberspace

Witness: Yes

Apc: Did you have any challenge making a copy from the official copy in the studio

Witness: We only keep them in the libraries, and I got a call by at about 11pm. For shortness of time, I accessed the online copy

Apc: The versions are kept in the library. Do you normally submit copies to NBC

Witness: NBC comes sometimes to get records of broadcast and visitors

Apc: I'll be right to say that since this was an official order of court, you'll prefer to use the official copy.

Witness: If I had enough time, I'd have even gone to my hard drive to get it because I'm the correspondent.

Apc: You were instructed by AIT who received the subpoena

Witness: ASAP, get this as soon as possible.

Apc: Apart from the events of 22nd November, you also gave full coverage of the events leading to presidential elections.

Witness: Yes

Apc: Do you access copies from other media houses?

Witness: Our news is breaking, we don't accept second hand report

Apc: Do you recall a breaking news of 23rd of February 2023 that INEC chairman was no longer going to be transmission of results.

Witness: INEC chairman I covered did not mention that they will no longer transmit. I was there on the 22nd, 23rd 24th and I can confirm that there was no such.

Apc: So you'll be surprised to see that news.

Witness: Newspaper can get information from interviews. We deal with cameras.

That's would be all.

SAN Ikwueto: applies for the discharge of the witness, who he says. Indeed, she has shown that she's a professional broadcaster

JusticeTsammani: Are you marketing her?

SAN Ikwueto: My Lord, trading, that's what my people do very well

Go and ask Peter Obi

Lolllll

SAN Ikwueto: Appreciates the court for the indulgence and hands over to SAN Livy, who thanks the court for the opportunity to call their last witness for the day.

He says that with that witness, they do not have any problem with the application of the respondents 4 a free day tomorrow.

SAN AB Mahmoud: The Court asked for our views, and we gave our views and didn't apply for anything.

SAN Livy: Fine, then we're ready to come back tomorrow, my Lord.

The Court now adjourns till Monday, June 19, 2023, at 2pm for the continuation of hearing.

We are back to the afternoon session, my people.

The court thanks everyone and thanks God that today is Friday!✊

BREAKING: Court Orders DSS To ‘Immediately’ Grant Emefiele Access To Lawyers, Family

DSS may ignore the court order thesame way Emefiele ignored the court during his cashless policy .

The Director General of the Department of State Services (DSS) and the DSS has been ordered to immediately grant the suspended Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, unrestricted access to his lawyers and family members as it is within his constitutional right.

Emefiele was arrested by the DSS on Saturday, hours after his suspension by President Bola Tinubu on Friday evening.

The order came from Justice Hamza Muazu of the Federal Capital Territory (FCT) High Court sitting at Maitama Abuja on Friday, following an application by J.B. Daudu SAN, counsel to Emefiele.

He informed the court that he had written letters to the DSS, particularly on June 14, for the purpose of taking further instruction from him, but the DSS has refused to respond to the application.

On the other hand, counsel to the second and third respondents, I. Awo, told the court that the DSS did not have the penchant for refusing such a request and that it was wrong to do so.

However, he expressed certainty that the security service would abide by the order of court and grant access to the listed lawyers and family members of Emefiele to see him, while counsel to the Office of the Attorney General of the Federation did not oppose the application.

In another development, counsel to the DSS, as well as the Office of the AGF, requested extension of time to file their respective responses to the originating motion, which was granted and the suit was further adjourned till Tuesday, June 19 for hearing of the substantive suit.

SHOCKING... Something New Is About To Happen’ – Pastor Adefarasin Speaks On Tinubu’s Administration

In the past 14 days, Nigeria has witnessed the most impactful reforms in the oil and gas sector, educational sector and power sector, introduced by President Tinubu. If he can do this in just 14 days, imagine what he will do in 4 years. So I agree that Something New will happen.

Senior Pastor of House on the Rock, Pastor Paul Adefarasin, has applauded President Bola Tinubu, for the suspension of the governor of the Central Bank of Nigeria (CBN), Godwin Emefiele.

Naija News reports that the clergy spoke at the church’s recent programme in a video making the rounds online.

Recall that Emefiele was suspended as the apex bank boss by President Tinubu last week Friday, and was subsequently arrested by operatives of the DSS in Lagos and flown to Abuja in a private jet on Saturday.

Speaking on this, Adefarasin declared that the arrest is the greatest news in recent times, stressing that Emefiele has misguided and misused the wealth of the nation.

According to him, the latest development is a sign that something new is about to happen in Nigeria and urged Christians to be sensitive about the new thing which is about to happen.

INEC calls 18,000 blurred Labour Party IReV sheets an ambush

There's no way INEC and Tinubu will escape this  Breakdown of Results in INEC iREV Portal:
1. 840 results not accessible.

2. 8,217 results blurred and unreadable.

3. 527 results cancelled.

4. 164,279 uploaded a week after election.

The Independent National Electoral Commission (INEC) has expressed its dissatisfaction with the submission of 18,000 blurred Incident Report (IReV) sheets by the Labour Party (LP), describing it as an ambush.

On Thursday, the Labour Party (LP) submitted 18,000 polling unit results that were blurred during the presidential election to the tribunal.

LP presidential candidate Peter Obi has challenged the election process that resulted in President Bola Tinubu's victory, as announced by the Independent National Electoral Commission (INEC).

The defendants in the lawsuit include INEC, Tinubu, Vice President Kashim Shettima, and the All Progressives Congress (APC).

Reporting from the proceedings, it has been disclosed that Onyechi Ikpeazu, the legal representative for the petitioners, has submitted data analysis reports on the presidential election. These reports were presented through Eric Ofoedu, a professor of mathematics at the Nnamdi Azikiwe University, Awka, who was also a witness for the LP.

Ikpeazu revealed that the documents included inquiries into IReV score sheets from Rivers and Benue states.

The petitioners have submitted 18,000 polling units with blurred results obtained from the IReV portal.

The admissibility of the documents was objected to by Abubakar Mahmoud, who serves as the lead counsel for INEC.

According to Mahmoud, the situation was akin to an ambush. He further stated that the LP had provided a copy of the witness' statement only a few hours prior to the start of the proceedings.

Admittedly, my team and I are facing a challenge and are unsure of the next steps to take. According to him, it is an ambush.

It was expected that the counsel would have presented the statement earlier, in accordance with the court's regulations and in the spirit of collaboration. The meal ought to have been delivered promptly to prevent this surprise attack

Mahmood has made a plea to the court, requesting that the LP be compelled to allow the INEC legal team a 48-hour period to review the documents that have been submitted.

Despite objections from Wole Olanipakun, the counsel for Tinubu and Shettima, they ultimately agreed to hear the witness's statement and suggested a later time for cross-examination.

Arise News TV journalist Lumnie Edevbie was summoned as a witness for the LP and was presented as evidence by Patrick Ikweato, a senior advocate of Nigeria (SAN) who is part of the party's legal team.

During the trial, a witness presented a video statement from Yakubu Mahmood, the chairman of INEC, which was recorded at Chatham House in London on January 17. In the video, Mahmood expressed confidence in the reliability and efficiency of the bimodal voter accreditation system (BVAS).

According to all respondents, they objected to the adoption of the statement of the witness and the viewing of the video.

The session was adjourned by the five-man panel, headed by Haruna Tsammani, until Thursday. This was done to allow for the cross-examination of the witness and further hearing of the petition.

Again, INEC, Tinubu Oppose IREV Reports From Rivers, Others But Tribunal Admits Them As Obi’s Evidence

Again, INEC, Tinubu Oppose IREV Reports From Rivers, Others But Tribunal Admits Them As Obi’s Evidence

The documents were tendered on Monday by the lawyer representing the presidential candidate of Labour Party, Peter Obi, Audu Anuga SAN, who urged the court to admit them as part of his client’s evidence.

The Presidential Election Petitions Court sitting in Abuja, on Monday, admitted in evidence certified true copies of INEC Results Viewing Portal (IReV) reports for Adamawa (21 LGAs), Ogun (20LGAs), Ekiti (16 LGAs), Rivers (19 LGAs) and Akwa Ibom states (25 LGAs).

He also tendered blurred results obtained from the IReV portal for Ogun State.

The application made by Obi’s legal team was unanimously opposed by the legal team of the Independent National Electoral Commission, President Bola Tinubu, Kashim Shettima and the All Progressives Congress, APC.

The respondents said they would advance their reasons for objecting to the documents at their final written address before the judgement.

The court led by Justice Haruna Tsammani noted the objections of the respondents but eventually admitted the documents as evidence while marking them as exhibits.

Another lawyer representing Obi, Afuba Peter SAN, equally tendered certified true copies of Form EC40GBU for Niger state (10 LGAs), Osun state ( 7 LGAs) ( Edo (3 LGAs), Sokoto states(5 LGAs) and asked the court to admit them.

The forms show the number of registered voters and polling units where elections were either cancelled or did not take place.

The respondents again opposed the tendering of the electoral documents but the PEPC still admitted them as Obi’s evidence.

The petitioners subsequently called for adjournment so as to file more documents.

The prayers were granted and the case was further adjourned to Tuesday.

THE WHISTLER reports that the flagbearer of the Labour Party, Obi, has so far presented a lawyer (who spoke on a US District Court judgement on Tinubu’s bank account), Senior Reporter/Editor, Lucky Ukpewo from Channels Television as well as a software engineer to substantiate alleged non-ompliance to the Electoral Act during the elections by INEC.

He is disputing the polls in over 18,000 polling units.

Tinubu Signs Electricity Act 2023, to de-monopolise Nigerian electricity generation, Empowers

Tinubu Signs Electricity Act 2023, to de-monopolise Nigerian electricity generation, Empowers individual, States, Private Companies To Generate Power...

de-monopolise Nigerian electricity generation, transmission, and distribution of electricity at the national level.

This new law will empower states, companies, and individuals to generate, transmit and distribute electricity in the country.

The Nigerian President, Bola Tinubu, has signed the 2023 Electricity Act which is a replacement for the Electricity and Power Sector Reform Act of 2005 into a law.

The newly enacted law will de-monopolise Nigerian electricity generation, transmission, and distribution of electricity at the national level.

This new law will empower states, companies, and individuals to generate, transmit and distribute electricity in the country.

Recall that the Electricity Act 2023 was initially passed by lawmakers in July 2022 to allow the states to issue licences to private investors who can operate mini-grids and power plants within the state.

But the Act precludes interstate and transnational electricity distribution.

The Nigerian Energy Regulatory Commission (NERC) would be able to govern the energy industry within Nigeria under the Electricity Act 2023, without prejudice to the states' authority to pass laws, create electricity markets, and regulate those markets.

The Act specifies how NERC can delegate regulatory authority to state regulators once they are constituted. NERC will continue to regulate energy business conducted solely in those states until those states' electricity market regulations are passed.

For the time being, Lagos, Edo, and Kaduna states already have power market regulations in place and may begin regulating their markets. However, NERC will regulate in states where such regulations do not exist. NERC will continue to carry out cross-border rules, regulating generation and transmission across states.

The Act also empowers parliamentarians to carry out oversight tasks and exercise control over the NESI through the Senate and House Committees on Power. This is should be done regardless of any government Ministry's supervisory authority over government-owned firms or other entities engaged in the Nigerian energy supply industry.

Electricity generation licensees are required by NERC to meet renewable generation obligations. The Act requires electricity generating firms to either create power from renewable energy sources, purchase power generated from renewable energy, or purchase any instrument representing renewable energy generation.

The Electricity Act also mandates the imposition of renewable purchase obligations on distribution or supply licensees.

President Tinubu today announce the appointment of former Economic and Financial

Sources close to the presidency informed THE WHISTLER that Ribadu was picked ahead of two other candidates that were being considered for the top security job.

President Bola Tinubu will any moment from today announce his appointment of former Economic and Financial Crimes Commission (EFCC) chairman, Nuhu Ribadu, as National Security Adviser (NSA).

As part of his efforts to fulfill his promise of delivering a “bold, no-nonsense crime prevention reform” to safeguard Nigerians, President Tinubu evaluated the three candidates for the NSA position before finally settling for Ribadu who is widely regarded as one of Nigeria’s experienced individuals in the field of security and law enforcement.

The two other candidates that were also considered are former Minister of Interior and ex-Chief of Army Staff, retired General Abdulrahman Bello Dambazau; and the current Director-General of the National Intelligence Agency (NIA), Ahmed Rufai Abubakar.

The NSA serves as the principal adviser to the President on security matters, responsible for coordinating various security agencies, providing intelligence assessments, and formulating policies to address the nation’s security challenges.

The NSA position requires a capable and experienced individual who can navigate complex security issues and provide effective counsel to the President and Tinubu, according to sources, was determined to pick an individual who can help to effectively address the pressing security challenges facing the nation.

While the appointment is yet to be officially confirmed, insiders told THE WHISTLER that President Tinubu holds Ribadu in high regard and values his expertise and dedication to public service. The selection of Ribadu, when announced, will count among the first few important appointments to be made by the newly sworn-in president

Your govt is temporal - Atiku tells Tinubu

Atiku Abubakar has expressed confidence that he will reclaim his alleged stolen mandate at the court.

He, therefore, referred to the President Bola Tinubu-led APC administration as a “temporary government”.

Atiku or Peter Obi who is taking over the so called Asiwaju “Temporary government”?? Both men need to decide who came 2nd position first before fighting for the Top position!

Same Atiku called Buhari administration temporary after 2019 election and Buhari has completed his term

Atiku Abubakar who addressed elected officials of the PDP during a stakeholders meeting held at the Government House Banquet Hall in Bauchi on Saturday, charged members of the National Assembly of the PDP not to be “rubber stamp members of the National Assembly”.

He added; “You are there to serve as a formidable opposition to this temporary administration.”

According to him, “Based on the results announced by the INEC and pending the determination of electoral challenges in the court, our members elect are not the majority in the National Assembly.

“So, for the time being, they have to prepare to work as an effective, constructive opposition while also preparing for possible roles of the majority party when the cases are resolved. A Government in waiting, so to speak.”

Atiku Abubakar stressed that, “In the recently concluded elections, our party campaigned on specific things, Nigerians are therefore expecting you to work on how to fulfil those campaign promises. That you are not among the INEC selected members is not an excuse not to perform, you must collectively work to put the temporary government on the right direction to serve Nigerians. Don’t be part of rubber stamp.”

NNPC NATIONWIDE Petro PRICES IS ILLEGAL!

LEAKS: NNPC LTD NATIONWIDE PMS PUMP PRICES IS ILLEGAL!

The new pricing template released by the NNPC Ltd is illegal to the extent that both the 2023 Appropriation Act and the former PMB's Federal Government through the former Hon. Minister of Finance approved that the fuel subsidy removal policy is to come into effect on June 31st, 2023 as provided for in the 2023 Appropriation Act.

Hence, what is going on at the moment in this regard is illegal. Both the NNPC Ltd and the downstream regulator are in defiance of the Appropriation Act and directive of the Federal Ministry of Finance on this matter.

Furthermore, the new pricing template released by the NNPC Ltd is a mere allocative pricing regime and not free market competitive supply and demand driven pricing regime!

The new pricing regime or template defies the basic and fundamental principles of a deregulated pricing regime as championed by the government, the NNPC Ltd and private market operators in the industry!!

And, by the way, it is not the statutory responsibility of the NNPC Ltd to generate a pricing template for petroleum products. It is the statutory responsibility of the downstream regulator (probably, in consultation with the President or his designated Minister of Petroleum and or Finance).

NNPC Ltd  is an operator in the industry like Dangote Refinery and Petro Chemicals Ltd, Oando, etc etc. Therefore, it cannot wear two caps at the same time; operator and regulator!!!

Even if the new price template is applicable to the NNPC Ltd retail outlets only, there is the need for the NNPC Ltd Management to obtain permission or clearance from the downstream regulator for them to adjust its prices upward in the market just as it is with the electricity supply and the telecoms industries whereby the Nigerian Electricity Regulatory Commission (NERC) and Nigerian Communications Commission (NCC) are the statutory entities respectively that permit electricity tariff and telecoms rates changes or upward adjustments.

Therefore, it is illegal to start charging new PMS price before June 31st 2023.

Finally, President Bola Ahmed Tinubu (PBAT) swore to an Oath of office and Alligiance to the Constitution of the Federal Republic of Nigeria and the Law in running his administration. This illegal act by the NNPC Ltd is a dent on and an affront to the Oath of office sworn by PBAT on Monday, May 29th, 2023!!!

Tinubu’s Lawyers catch Cold As Tribunal accept BVAS Report, Others Exhibit Against Pres Tinubu..

The Presidential Election Petition Court sitting in Abuja has admitted the 2023 presidential election results announced by the Independent National Electoral Commission’s chairman, Yakubu Mahmoud, as an exhibit in the petition filed by the Peoples Democratic party and its presidential candidate, Atiku Abubakar, against the electoral victory of President Bola Tinubu.

The results were admitted following an oral application by the PDP lawyer, Eyitayo Jegede, SAN.

Jegede also applied to tender as evidence, INEC Forms EC8A (which is the summary of presidential election results), Form EC8E series for the 36 states and the Federal Capital Territory, INEC Certified documents in respect of number of PVCs collected for 2023 presidential election and the Bimodal Voter Accreditation System BVAS machine printed report for the 36 states including FCT.

The court then asked the lawyers representing INEC, Tinubu and the All Progressives Congress if they have any objection to the documents that the PDP sought to tender.

Responding, INEC’s counsel, A.B. Mahmoud SAN, did not object to the certified copy of the final results declared by the INEC chairman.

But he said he would object to the other documents because they were bulky and needed to be appropriately numbered.

On his part, Tinubu’s legal team led by Wole Olanipekun SAN did not consent to the admission of the BVAS reports.

He contended that the BVAS reports are more like an evidence that needs to be vetted by them before it can be admitted.

The legal team for the APC also aligned with the submission of Tinubu’s lawyer, Olanipekun.

Nevertheless, the five-man panel of the court led by Justice Haruna Tsammani admitted all the documents tendered by the PDP while taking note of the respondents’ refusal to give consent to its admission.

The court subsequently adjourned to Wednesday for continuation of hearing.

Recall that in its pre-hearing report, the PEPC had ordered that all INEC certified documents be admitted and not objected to at the point of admission, as agreed by parties.

According to the court, this was to fast-track the case.

SHOCKING.. FG no going back, Fuel Subsidy Remove

JUST IN: FG Owes NNPCL N2.8trn For Fuel Subsidy – Kyari

Opadele Abdulkabeer

May 30, 2023

The federal government has a N2.8 trillion fuel subsidy payment imbalance owed to Nigerian National Petroleum Company Limited (NNPCL).

After meeting with President Bola Tinubu on Tuesday, NNPCL’s Group Chief Executive Officer (GCEO), Mele Kyari, said this while speaking to journalists at the Presidential Villa in Abuja.

The Nigerian Mainstream and Downstream Petroleum Regulatory Authority (NMDPRA) Authority Chief Executive Officer, Farouk Ahmed, joined Kyari at the briefing. Farouk Ahmed said the disclosure by the president in his inauguration speech about the end to the subsidy regime was most welcome as it is no longer sustainable.

He said the heavy subsidy burden had made it impossible for the NNPCL to have funds to channel into its core businesses.

Kyari said the petrol queues that started resurfacing across the country since Monday were understandable as marketers would like to understand the meaning of the president’s pronouncement that “subsidy is gone.”

The NNPCL GCEO said the uncertainty on the remark also caused consumers to rush for the product, a situation which has resulted in the queues seen at fuel stations.

He said government would initiate measures to cushion the effects of the removal of subsidy.

He stated “since the provision of the N6 trillion in 2022, and N3.7 trillion in 2023, we have not have not received any payment whatsoever from the Federation.

“That means they (Federal Government) are unable to pay and we’ve continued to support this subsidy from the cash flow of the NNPC. That is, when we net off our fiscal obligations of taxes and royalty, there’s still a balance that we’re funding from our cash flow and that has become very difficult and affecting our other operations.

“We’re not able to keep some of these cash for invest on our core businesses and the end result is that it can be a huge challenge for the company and we have highlighted this severally to government that they must compensate and NNPC they must pay back the NNPC for the money that we have spent on the subsidy.

“So, today the country doesn’t have the money to pay for subsidy. There’s incremental value that will come from it. But it is not an issue of whether you can do it or not because today we can’t afford it and they are not able to pay our bill. That comes to how much is the federation owing NNPC now.

“Today, we are waiting for them to settle up to N2.8 trillion of NNPC’s cashflow from the subsidy regime and we can’t continue to build this,” he explained

Shocking... Leak Document from U.S. Court Against Tinubu

Shocking... Leak Document from U.S. Court, Other Documents Tendered By Peter Obi Against Tinubu

The judgment allegedly indicted Tinubu and ordered his forfeiture of $460,000 in a drug-related offence.

The Presidential Election Petition Court (PEPC) has admitted in evidence documents tendered by the candidate of the Labour Party in the 2023 presidential election, Peter Obi, to defend his petition against President Bola Tinubu.

Obi had filed a petition at the tribunal to challenge Tinubu’s victory in the election as declared by the Independent National Electoral Commission. Tinubu was sworn in as President on Monday, May 29.

The documents which were tendered on Tuesday in Abuja through the petitioner’s first witness, Mr Lawrence Nwakaeti, included a United States District Court judgment.

The judgment allegedly indicted Tinubu and ordered his forfeiture of $460,000 in a drug-related offence.

Nwakaeti, who was led in evidence by Mr Jibrin Okutepa (SAN), told the court that he was a registered voter who voted at a polling unit in his hometown in Anambra on February 25, 2023, the News Agency of Nigeria reports.

The counsel for the respondents raised objections to the admission of the document in evidence but reserved their arguments to their objections until the final address stage.

Under cross-examination by the counsel for Tinubu, Mr Wole Olanipekun (SAN), the witness admitted that the judgment was not registered in Nigeria.

Nwakaeti also admitted that there was no certificate from any Consular in Nigeria or the U.S. in support of the judgment but that the judgement was obtained and certified by the person in whose custody it was.

The witness told the court that he had been to the U.S. and also read the judgment in its entirety, adding that he would be surprised if no mention was made of the forfeiture of $460,000 by Tinubu

While also cross-examining the witness, the counsel for the All Progressives Congress (APC), Mr Lateef Fagbemi (SAN), sought to know if the document had the certification of any police officer in the U.S.

One Zero : Tinubu Remove Fuel Subsidy

No Need For Panic ... NNPC Backs Tinubu On Fuel Subsidy Removal, Says is a Renew Hope

The company tells Nigerians that the move to remove subsidy is in its best interest.

The President, in his inaugural address on Monday, had declared an end to the era of subsidy payment, saying the 2023 budget made no provision for fuel subsidy, so further payment was no longer justifiable.

Responding in an emergency press conference at the NNPC Towers, Abuja, NNPCL told Nigerians that the move was in the best interest of the company.
